Welcome to Ponsatlas (“Company”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of our website, services, products, training programs, consulting services, and software applications (“Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Acceptance of Terms

By using our Services, you confirm that you:

• Are at least 18 years old,
• Have the legal capacity to enter into a binding contract,
• Are using the Services in compliance with these Terms and all applicable laws.

If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Services Provided

Ponsatlas offers:

• Atlassian consulting services (implementation, advisory, configuration),
• Atlassian training programs,
• Atlassian Cloud license resale,
• Custom software development,
• Atlassian Marketplace applications,
• Modern collaboration & team productivity solutions,
• Content, articles, templates, and other materials.

We may update, modify, or discontinue any portion of the Services at our discretion.

3. Accounts & Access

Some Services may require you to create an account or provide information. You agree to:

• Provide accurate and complete information,
• Maintain the confidentiality of your account credentials,
• Notify us immediately of any unauthorized use.

You are responsible for all activities occurring under your account.

4. Use of the Services

You agree not to:

• Violate any applicable law or regulation,
• Reverse engineer, copy, or modify our software or content,
• Misuse the Services or attempt to gain unauthorized access,
• Submit harmful code, spam, or malicious activities,
• Use the Services for fraudulent, abusive, or inappropriate purposes.

We reserve the right to suspend or terminate access for violations.

5. Intellectual Property

All content, trademarks, branding, software, documentation, training materials, and other intellectual property provided by Ponsatlas remain the exclusive property of Ponsatlas or its partners.

You may not:

• Reproduce,
• Distribute,
• Sell,
• License,
• Modify or create derivative works

without prior written permission.

Atlassian®, Jira®, Confluence®, Bitbucket®, and related trademarks belong to Atlassian Pty Ltd. Ponsatlas is an independent Solution & Training Partner and a Marketplace Vendor—not an Atlassian subsidiary.

6. Third-Party Services

Our Services may integrate with third-party tools such as Atlassian Cloud, Google Workspace, Slack, HubSpot, and others.

We are not responsible for:

• Availability of third-party services,
• Their terms, policies, or practices,
• Any issues arising from your use of third-party solutions.

Your use of third-party tools is governed by their respective terms.

7. Marketplace Applications

If you use our Atlassian Marketplace apps:

• Atlassian Marketplace Terms apply,
• Your data is processed according to Atlassian’s and Ponsatlas’s privacy statements,
• Updates may be automatically deployed.

We may collect anonymized usage analytics to improve the app.

8. Payment & Billing

For paid services or software:

• Fees are specified at the point of purchase or in your service agreement,
• All payments are non-refundable unless otherwise specified,
• Prices may change with notice.

For Atlassian license resale, billing is subject to Atlassian Partner Program rules.

9. Training & Consulting Services

You acknowledge that:

• Consulting, advisory, and training services are provided on a best-effort basis,
• Results may vary based on your environment, team, and organizational readiness,
• Ponsatlas is not responsible for internal implementation beyond the agreed scope.

Deliverables and timelines must be defined in the signed proposal or statement of work (SOW).

10. Data Privacy & Security

Your use of the Services is also governed by our Privacy Policy.

We take industry-standard measures to protect your data, but no system is fully secure.

By using our Services, you acknowledge and accept inherent risks of online data transmission.

11. Limitation of Liability

To the maximum extent permitted by law:

• Ponsatlas is not liable for indirect, incidental, special, or consequential damages.
• Our total liability for all claims related to the Services will not exceed the amount paid to us in the last 12 months.
• Services are provided “as is” without warranties of any kind.

12. Termination

We may suspend or terminate your access if:

• You violate these Terms,
• You misuse the Services,
• Required payments are overdue.

Upon termination, your rights to use the Services immediately cease.

13. Governing Law

These Terms are governed by the laws of:

• Turkey,
• or
• European Union / France,
• depending on your contracting entity or region.

Any disputes shall be resolved in the appropriate courts located in İstanbul unless otherwise agreed.

14. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date.

Continued use of the Services constitutes acceptance of the updated Terms.
